Today’s News Synopsis:

Governor Schwarzenegger signed a bill protecting homeowners, with lender approval, from deficiency judgments. 30-year mortgage rates dropped to 4.27%, said Freddie Mac. President Obama refused to sign the Interstate Recognition of Notarizations Act, which would have allowed federal and state courts to recognize notary signatures from other states. Realtytrac users will soon be able to view sales prices, sale dates, and other sorts of information on foreclosure sales.

Inman - “Calif. short-sellers avoid deficiency judgments” (10-7-10)

“California Gov. Arnold Schwarzenegger has signed into law a bill that protects homeowners who get their lender’s approval for a short sale from deficiency judgments, but vetoed related legislation that would have extended similar protections to homeowners who have refinanced their mortgage.”

Associated Press“Mortgage rates fall to decades-low of 4.27 pct.” (10-7-10)

“The average rate for 30-year fixed loans dropped to 4.27 percent, mortgage buyer Freddie Mac said Thursday. That’s the lowest on records dating back to 1971, and down from 4.32 percent the previous week.”

“President Obama will not sign H.R. 3808, the Interstate Recognition of Notarizations Act, which would have allowed federal and state courts to recognize notary signatures from other states.”

Housing Wire“RealtyTrac to provide pricing on previously sold foreclosures” (10-7-10)

“RealtyTrac, an online foreclosure marketplace, added a new feature that allows users to see information such as pricing on properties sold in the last nine months. The data will be available for more than 2.5 million recently sold properties. Users will be able to view sales prices, sale dates, foreclosure status of the property when it was sold, number of bedrooms, bathrooms, square footage, lot size and the year the home was built.”

Housing Wire“FHFA faces another lawsuit over PACE program” (10-7-10)

“The Natural Resources Defense Council has sued the Federal Housing Finance Agency and the Office of the Comptroller of the Currency claiming the agencies illegally halted the Property Assessed Clean Energy program, known as PACE.”

Housing Wire“Hope Now: Industry completes nearly 150,000 loan mods in August” (10-7-10)

“Hope Now, a private sector alliance of mortgage servicers, investors, mortgage insurers and nonprofits, said the industry completed nearly 150,000 permanent loan modifications in August, with 91% of proprietary modifications including a reduction of principal and interest.”

Housing Wire“Weekly jobless claims down 2.4% to 445,000″ (10-7-10)

“Initial jobless claims fell 2.4% last week to 445,000, which is the lowest level in a few months and lower than most analysts’ estimates. The Labor Department said the seasonally adjusted figure of actual initial claims for the week ended Oct. 2 decreased by 11,000 from the previous week’s upwardly revised figure of 456,000.”

Orange County Register – “First-time homebuyers at record high” (10-7-10)

“The leading edge of the 10- to 30-year-old age group — also known as Gen Y or echo boomers — already is emerging as a factor in the housing market, said Joel Singer. For example, the average age of first-time buyers is 30 years old, and first-time buyers now make up 46% of the the market. First-time sellers make up 47% of the market.”

Looking Back:

One year ago, John Burns Real Estate Consulting claimed home prices would likely decrease again. Both the NAR and the MBA were in favor of extending the first time home buyer tax credit. A survey from the California Association of Realtors showed that 46 percent of California Realtors used some sort of social networking website in their work.

Energy efficiency loans hit the skids as many banks see the risk outweighing the rewards. A White House-created commission look at possibly increasing the age for retirement benefits with the backing of AARP. California rates as one of the country’s hottest real estate markets for price increases while a PMI Mortgage Insurance Co. report lists 7 California areas (both northern and southern) that will most likely witness price declines in the next two years.

“The percentage of households that could afford to buy an entry-level home in California stood at 64 percent in the second quarter of 2010, compared with 67 percent for the same period a year ago, according to a report released today by the CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.).”

Los Angeles Times “Loan program for green home upgrades stalls” (8-19-10)

“Funds dry up, and many projects are left in limbo, after regulators and lenders raise alarms over terms of the Property Assessed Clean Energy program.”  This is better known as PACE in most green circles.

Wall Street Jounral -“Cuts in Social Security Weighed by Fiscal Panel” (8-19-10)

“A White House-created commission is considering proposals to raise the retirement age and make other changes to shore up the finances of Social Security, prompting key players to prepare for a major battle over the program’s future. The commission is looking into ways to address the country’s long-term fiscal problems, but even before it settles on proposals many liberals are vowing to block cuts in retirement benefits. Some key players appear open to a deal, however, including the White House and the powerful senior group AARP.”

Housing Wire - “MBA Convinces Florida to Drop Certain Mortgage Underwriter Requirements” (8-19-10)

“In the first part of 2010, the Florida Office of Financial Regulation (OFR) passed a mandate that mortgage processors and underwriters must become licensed as loan originators. According to an email sent today from the Mortgage Bankers Association (MBA), the trade group successfully convinced the OFR to reverse this requirement.”

Wall Street Jounral “Mortgage Delinquency Runs Slightly Higher in Dems’ Districts” (8-19-10)

“On average, districts represented by Democrats have an average serious delinquency rate of 9.9%, while the Republicans, which represent 77 fewer districts, have an average rate of 8.7%.”

OC Register“Calif. ranks as third-hottest home market” (8-19-10)

“California slipped from first place to third in home price gains in CoreLogic’s latest home-price report.”

Inman “Top 20 metros at risk of price declines” (8-19-10)

“The risk of price declines in the next two years declined during the first quarter in 75 percent of 384 markets tracked by PMI Mortgage Insurance Co., including 40 of the 50 nation’s most populous metro areas.” 7 of of 10 for California isn’t that bad. Right?

“The government should create an apartment real estate investment trust (REIT) to rent out foreclosed properties — a method that would avoid flooding the housing market with foreclosed properties, a real estate consultant said as President Obama’s “Future of Housing Finance Conference” kicked off Tuesday.”

“The study distinguishes debt across the following types of accounts: mortgage accounts (including home equity installment loans (HEL)), home equity revolving accounts (HELOCs), auto loans, credit cards, student loans, and other loan accounts including consumer finance, retail stores and gas station accounts. As of June 30, American consumers owed $11.7 trillion, down 1.5 percent from the previous quarter and 6.5 percent below the peak level for consumer debt ($12.5 trillion) at the end of the third quarter of 2008. This downward trend has now continued for seven quarters.”

According to MDA DataQuick, 8,373 homes closed escrows in the Bay Area last month. Freddie Mac announced the average rate for 30-year fixed loans this week was 4.57 percent. The Federal Open Market Committee expects economic expansion to increase considerably slower over the next couple years than it previously expected. California is currently the second most popular place for foreign home buying.

Business Journal – “Brown sues housing agency over halt to PACE programs” (7-14-10)

“California Attorney General Jerry Brown on Wednesday filed a lawsuit against The Federal Housing Finance Agency and mortgage giants Fannie Mae and Freddie Mac in the wake of the federal agency’s negative assessment of the Property Assessed Clean Energy Program. Brown, California’s Democratic candidate for governor, asks the court to require Fannie Mae and Freddie Mac to recognize PACE assessments.”

DQNews - “Bay Area June Home Sales Send Mixed Signals” (7-15-10)

“Last month a total of 8,373 homes closed escrows in the nine-county Bay Area, up 1.3 percent from 8,264 in May but down 3.1 percent from 8,644 in June 2009, according to MDA DataQuick of San Diego.”

Los Angeles Times“U.S. home foreclosures reach record high in second quarter” (7-15-10)

“U.S. bank repossessions increased 38% in the second quarter from the same period a year earlier for a record total of 269,952, according to Irvine research firm RealtyTrac. That was also a jump of 5% from the previous quarter. If that pace continues through the year, the number of homes taken by banks is likely to top 1 million by the end of 2010, said Rick Sharga, RealtyTrac senior vice president.”

San Francisco Chronicle“Mortgage rates remain at lowest level in decades” (7-15-10)

“Government-sponsored mortgage buyer Freddie Mac said Thursday the average rate for 30-year fixed loans this week was 4.57 percent. That’s the same as a week earlier and the lowest since Freddie Mac began tracking rates in 1971.”

Housing Wire“Value of JPMorgan Government-Backed REO Triples Since 2009″ (7-15-10)

“REO insured by the US government totaled $1.4bn in Q210 compared to $508m in Q209. The latest results are nearly double the total from Q110, $707m. In addition, JPMorgan said nonaccruing mortgages insured by US government agencies were up 140% from Q209, at $10.1bn in Q210 compared to $4.2bn one year ago. Nonaccruing mortgages are those that are late and no longer acrruing interest. That volume is down, however, from $10.5bn in Q110, JPMorgan said.”

Housing Wire“Feds: No Need to Change Rates Despite Slowdown in Housing” (7-15-10)

“The Federal Open Market Committee (FOMC) in its June 22-23 meeting decided to maintain its target zero to 0.25% federal funds rate despite signs of slowdown in economic and housing growth, according to meeting minutes released this week. Data on production and spending since the Feds’ last meeting remained aligned with expectations, but the pace of economic expansion over the next year and a half looks to be somewhat slower than previously predicted.”

Inman - “6 strategies for a realistic asking price” (7-15-10)

“Absorption rates are generally one of the most powerful ways to persuade sellers to be realistic. The calculation is relatively simple. In most areas, your local multiple listing service publishes how many months of inventory are currently on the market. Next, divide ’1′ by the number of months of inventory. This gives you the percentage of listings that are selling each month. It also tells you the seller’s odds of selling in a given month. For example, if there are 12 months of inventory on the market, that means that the seller’s odds or probability of selling in any month is 8.3 percent (1/12). The probability the seller won’t sell in a given month is 91.7 percent (11/12).”

Orange County Register – “18% more hotels in financial distress” (7-15-10)

“Atlas Hospitality Group reports 73 more California hotels were in high financial distress — in default on their mortgage or foreclosed upon — in the second quarter vs. a year ago. This 478 second-quarter total is an 18% increase from the first quarter 2010 and up 132% vs. a year ago”

Orange County Register – “Calif. No. 2 spot for foreign homebuyers” (7-15-10)

“Florida was the top target for foreign buyers with (22%) of transactions in past year. California was second at 12%; then came Arizona (11%) and Texas (8%.) California was tops as recently as two years earlier.”
