No settlements have been reached yet, Miller said in a telephone interview today. The other three are Citigroup Inc., Wells Fargo & Co. and Ally Financial Inc., said Miller, the leader of the 50-state investigation. The five have 59 percent of the market, Miller said.”

“Orange County foreclosure activity has been trending downward over the course of 2010, and may continue to improve marginally over the course of 2011. “Serving as leading indicators for the sector, two composite multifamily indices produced from NAHB’s survey of multifamily builders and property managers showed improvement in the third quarter of 2010. The NAHB Multifamily Production Index (MPI) increased to a value of 35.6, up from the 26.6 level reported for the second quarter. This is the highest the MPI has been since 2007.”

Mercury News“Mortgage rate for 30-year fixed loans hits 4.61 percent” (12-9-10)

“Freddie Mac said Thursday that the average rate on a 30-year fixed loan increased sharply from last week’s rate. And it is well above the 4.17 percent rate hit a month ago — the lowest level on records dating back to 1971.”

“Initial jobless claims fell nearly 4% last week to 421,000 after coming in at the lowest level in two years a few weeks ago. “Fitch Ratings expects another 10% decline in home prices in 2011, as the supply of distressed properties continues to weigh down the housing market. Accordingly, analysts maintained the agency’s negative outlook for the residential mortgage-backed securities space and said 53% of all investment-grade RMBS rated by Fitch have a negative outlook.”

One year ago, Gov. Schwarzenegger signed a bill which ensured that consumers could choose their own real estate service provider when purchasing a foreclosure. According to Zillow, Bay Area properties lost 3 percent of their value during the first 11 months of 2009. 18 percent of FHA loans were either delinquent or in foreclosure. Statistics from Freddie Mac showed that national home prices increased by .9 percent during the second quarter of 2009.

Freddie Mac announced it will suspend foreclosure evictions from Dec. 20 to Jan. 3, 2011. Automatic Data Processing reports the U.S. economy added 93,000 private-sector jobs during November. The Federal Reserve shared information about more than 21,000 individual transactions which provided $3 trillion in liquidity for market stabilization. According to the MBA, mortgage applications decreased 16.5% last week.

Mortgage Bankers Association“Refinance Activity Continues to Decline as Rates Rise in Latest MBA Weekly Survey” (12-1-10)

“The Mortgage Bankers Association (MBA) today released its Weekly Mortgage Applications Survey for the week ending November 26, 2010. The Market Composite Index, a measure of mortgage loan application volume, decreased 16.5 percent on a seasonally adjusted basis from one week earlier. This week’s results include an adjustment to account for the Thanksgiving holiday. On an unadjusted basis, the Index decreased 34.2 percent compared with the previous week.”

Mortgage Bankers Association“MBA: Commercial and Multifamily Mortgage Delinquency Rates Mixed in Third Quarter” (12-1-10)

“Delinquency rates for different commercial/multifamily mortgage investor groups were mixed in the third quarter, according to the Mortgage Bankers Association’s (MBA) Commercial/Multifamily Delinquency Report. The delinquency rate for loans held in CMBS is the highest since the series began in 1997. Delinquency rates for other groups remain below levels seen in the early 1990′s, some by large margins.”

“The Federal Reserve Board on Wednesday posted detailed information about more than 21,000 individual transactions that provided $3 trillion in liquidity to stabilize markets during the nation’s financial crisis.An analysis of the data by The Wall Street Journal showed Goldman Sachs used an emergency overnight loan program from the Fed 84 times for a total of nearly $600 billion. The Primary Dealer Credit Facility, announced in March 2008, was used 212 times by Morgan Stanley”

“Acting Comptroller of the Currency John Walsh said in testimony prepared for a congressional hearing today that his agency is directing national bank servicers to suspend foreclosures for borrowers actively seeking to qualify for loan modifications.”

Looking Back:

One year ago, the NAR reported that pending home sales increased during October by 3.7 percent. The California Board of Equalization claimed that most homeowners would see a decline in property tax after a deflation of 0.237 percent.  According to Real Estate Econometrics LLC, the commercial mortgage default rate on loans held by U.S. banks increased to 3.4 percent in the third quarter of 09.

“The average rate for 30-year fixed loans rose from 4.23 percent the previous week, mortgage buyer Freddie Mac said Thursday. It was the third weekly increase in a row.”

Sacramento Bee“State commercial loan delinquencies steady” (11-4-10)

The statewide commercial loan delinquency rate held steady at 1.28 percent in this year’s third quarter, the Sacramento-based California Mortgage Bankers Association said. The association said that was an increase of only 0.02 percent from the second quarter.”

“Commercial real estate rents are poised to rise in 2011 after reaching a low this year, according to Bruce Mosler, co-chairman of Cushman & Wakefield Inc., the largest closely held property services company.”

Bloomberg - “U.S. Commercial Property `Substantially’ Off Bottom, Vornado’s Roth Says” (11-4-10)

“U.S. commercial property prices are recovering and ‘substantially’ off the bottom after more than a year of decline, said Steven Roth, chairman of real estate investment firm Vornado Realty Trust.”

Looking Back:

One year ago, the MBA’s weekly mortgage survey showed that loan application volume increased by 8.2 percent, on a seasonally adjusted bases, from the previous week. The FHA expected 24 percent of all loans insured in 2007 to default. The Federal Reserve’s FOMC announced that it would not buy the full $200 billion debt amount that it had previously planned to take. BarCap reported that the 30-plus day delinquency rate increased to 5.5 percent in October 2009.

Multifamily lenders provided 40 less financing for apartment buildings in 2009, according to the MBA. RealtyTrac reports bank repossessions and foreclosure auctions hit record levels in the 3rd quarter. Jobless claims rose 2.8% last week, said the Labor Department. A survey shows that 93% of military homeowners have mortgages compared to just 64% of civilians.

Mortgage Bankers Association“MBA Reports 40 Percent Decline in Multifamily Borrowing in 2009 Among Diverse Lenders and Loan Sizes” (10-14-10)

“In 2009, 2,725 different multifamily lenders provided a total of $52.5 billion in new financing for apartment buildings with five or more units, according to the Mortgage Bankers Association’s (MBA) Annual Report on Multifamily Lending for  2009.  The 2009 dollar volume represents a 40 percent decline from 2008 levels.  The most active 122 lenders represented just four percent of active lenders, but 77 percent of the dollar volume lent.  Three-quarters of the active lenders made five or fewer loans over the course of the year.”

“Mortgage interest rates continue their descent into record territory, with the 30-year fixed-rate loan dropping to an average of 4.19% this week from 4.27% a week earlier, according to the latest Freddie Mac survey of lender offering rates.”

“Bank repossessions and foreclosure auctions hit record levels in the third quarter, RealtyTrac said on Thursday. 372,445 foreclosure auctions were scheduled in July, August and September, while 288,345 properties were repossessed by lenders over the same time period.”

The program ended a few weeks ago and the Treasury estimates the final cost to be about $50 billion.”

“More military members are paying a mortgage, and more tend to have larger amounts of credit card debt, when compared to the civilian population. The survey shows just more than half of military respondents (51%) report owning a home, compared with 57% of civilians. Bloomberg - “Mortgage Investors Urge State Attorneys General Not to Punish Bondholders” (10-14-10)

“A hasty and ill-formulated legal settlement may harm the investors of mortgage-backed securities, namely retirees, municipalities, government entities, state pension funds, retirement systems, universities, and charitable endowments. Chris Katopis, the Washington-based trade group’s executive director, said today in an e-mailed statement.”

Looking Back:

One year ago, Citigroup and other banks were held accountable for fraudulent loans which costed them more than $688 million. The Mortgage Bankers Association reported that mortgage loan application volume had decreased by 1.8 percent from the previous week.  JP Morgan Chase approved of trial modifications for 90 percent of its borrowers.

The loan limit guaranteed by Fannie Mae, Freddie Mac and the Federal Housing Administration will stay at the current level until the end of 2011. The average rate for 30-year fixed loans fell to 4.32 percent, according to Freddie Mac. The Labor Department’s weekly survey shows jobless claims fell 3.5%. RealtyTrac reports foreclosure sales increased 4.9% in the 2nd quarter.

The analysis shows that commercial real estate fundamentals are showing signs of a firmer stabilization as businesses eased job cuts and started to hire, consumers began to re-open their pocketbooks and as households increasingly looked to rent rather than own their homes.”

“Mortgage buyer Freddie Mac said Thursday the average rate for 30-year fixed loans fell to 4.32 percent, the lowest on records dating back to 1971. That’s down from 4.37 percent the previous week and equal to the average rate reached four weeks ago.”

Los Angeles Times“Prices rise for homes in foreclosure or sold by banks” (9-30-10)

“In the second quarter, 248,534 U.S. properties were sold by banks or by owners who had fallen into foreclosure, RealtyTrac of Irvine said. That was an increase of 4.9% from the previous quarter, but a 20.1% decline from the same quarter last year, when discounted bank-owned homes flooded the market.”

Housing Wire“Weekly jobless claims down 3.5%” (9-30-10)

“Initial jobless claims fell 3.5% last week to 453,000, which is at the level last seen at the beginning of the month and lower than most analysts’ estimates. The Labor Department said the unadjusted figure of actual initial claims for the week ended Sept. 25 decreased by 16,000 from the previous week’s revised figure of 469,000.”

“The U.S. real gross domestic product, which is the output of goods and services by labor and property, increased at an annual rate of 1.7% in the second quarter, according to the third estimate from the Commerce Department.”

“Janet Yellen is the new vice chairman of the Federal Reserve board, as the Senate unanimously confirmed her appointment Wednesday.”

Bloomberg - “JPMorgan Asks Judges to Delay Rulings as It Reviews Foreclosure Documents” (9-30-10)

“JPMorgan Chase & Co., the third- biggest U.S. mortgage servicer, said it’s asking courts to delay judgments in pending foreclosure cases while the bank reviews and possibly resubmits statements. JPMorgan began to ‘systematically re-examine’ foreclosure filings after learning that employees may have signed affidavits without personally reviewing underlying records, relying instead on other personnel”

Looking Back:

One year ago, Experian and Wyman estimated that the number of strategic defaults in 2008 were up to 600,000. Senators were supporting legislation to lend 200 million dollars for the prosecution of mortgage and real estate fraud cases.  The MBA reported that the mortgage loan application volume decreased by 2.8 percent on a seasonally adjusted basis. Freddie Mac announced that it would work with Titanium Solutions to do door-to-door loan modifications.

“While Fannie Mae issuance declined in August, the government-sponsored enterprise’s gross mortgage portfolio increased 3.8% from a year ago. The Fannie Mae gross mortgage portfolio reached $809.1 billion in August, up 3.8% from $779.4 billion a year ago. It did drop at a compound annualized rate of 4.1% in August.”

“‘It is going to be a long, slow recovery,’ said Harvey Rosenblum, executive vice president and director of research at the Federal Reserve Bank of Dallas. “If there is a beneficiary in the real estate downturn, it has been the multifamily sector, according to a market firm that studies the space. Net move-ins, nationally, in the second quarter, are higher than they have been in the past 15 years when comparing on a second-quarter basis, said Ron Witten, president of Witten Advisors, a Dallas-based consultancy that serves apartment developers, investors and lenders nationally with a focus on 40 major apartment markets.”

Orange County Register“Forecast: O.C. home prices up 2.2% in year” (9-29-10)

“Orange County home prices will rise 2.2% in the year ended September 2011, according to the latest forecast from housing tracker Veros from Santa Ana.”

Looking Back:

One year ago, C.A.R.’s sales and price report showed that single-family home sales increased 9 percent in August. The Standard & Poor’s/Case-Shiller home price index showed that prices were down 13.3 percent from 2008, but declines have slowed. Fannie Mae announced that the number of homes behind on payment or in foreclosure had increased by 4.17 percent. Also, FDIC Chairman Sheila Bair proposed that the agency should get banks to prepay three years of fees to help cover the cost of bank failures, expecting a $100-billion cleanup bill through 2013.

Existing home sales increased 7.6% last month, according to the NAR. The MBA reports commercial and multifamily mortgage debt decreased to $3.24 trillion in the second quarter. The CAR’s monthly analysis shows  California home sales rose 1.8 percent from July. Freddie Mac said mortgage rates did not change this week, despite Zillow’s claim they decreased.

“Existing-home sales1, which are completed transactions that include single-family, townhomes, condominiums and co-ops, increased 7.6 percent to a seasonally adjusted annual rate of 4.13 million in August from an upwardly revised 3.84 million in July, but remain 19.0 percent below the 5.10 million-unit pace in August 2009.”

“The level of commercial/multifamily mortgage debt outstanding decreased in the second quarter, to $3.24 trillion, according to the Mortgage Bankers Association’s (MBA) analysis of the Federal Reserve Board Flow of Funds data.”

“California home sales edged up 1.8 percent from July, but were down 14.9 percent from August 2009, the CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.) reported today. The statewide median home price also increased 1.2 percent from July and was up 8.6 percent from a year ago.”

“Fannie Mae will give REO agents and brokers who sell a previously foreclosed property to an owner-occupant a $1,500 bonus per sale. The government-sponsored enterprise will also give qualified homebuyers 3.5% of the final sales price that can be used toward the closing cost, including home warranty. Eligible offers must be submitted on or after Sept. 23 and must close by Dec. 31, 2010. Fannie said the sale must close within 60 days of the accepted offer.”

Housing Wire“MacroMarkets survey shows 2.2% drop in housing prices for 2H10″ (9-23-10)

“While many market participants provided a somewhat rosier outlook for home prices in a new survey, the average of the respondents still projects a 2.2% decline in the second half of the year. MacroMarkets said data from its September home price expectations survey show market analysts expect a 0.8% drop in home prices the full year with no improvement next year. Previous surveys showed steeper declines.”

“Freddie Mac said mortgage rates were unchanged this week, while another rate survey set new record lows. The Freddie Mac weekly survey put the average for a 30-year fixed-rate mortgage at 4.37% with an average 0.7 point for the week ending Sept. 23, stable from last week’s slight increase. A year ago, the average rate was 5.04%.”

Housing Wire“FHA’s Stevens to Senate: Capital ratio timeline would have ‘unintended impacts’” (9-23-10)

“Congress mandates that the FHA’s secondary reserves meet 2% of the total amount of its insurance guaranteed. Currently, it is at 0.53%. Last year, the FHA forecast it would be three to four years before that 2% ratio would be reached, and that he remains committed to that timeline.”

“Researchers from the Federal Reserve Bank of New York said new data show the uncertainty of inflation expectations has abated since the middle of 2008 and there is a continuing expectation that real wages will decline.”

Bloomberg - “GMAC Drew `False Testimony’ Sanction Years Before Eviction Halt” (9-23-10)

“Ally Financial Inc.’s GMAC Mortgage unit, which suspended evictions in 23 states last week after finding employees didn’t verify foreclosure documents, was sanctioned in 2006 for similar practices, court records show. GMAC gave ‘false testimony’ when it justified foreclosures by submitting sworn affidavits signed by a mortgage executive who later said in a deposition she didn’t actually review the loan documents or sign in the presence of a notary, according to a 2006 court order filed in Duval County, Florida.”

Bloomberg - “Credit Union Regulator in U.S. Seeks Bids on $800 Million in Property Debt” (9-23-10)

“The federal agency that regulates credit unions and insures more than 90 million U.S. accounts sought bids on about $800 million in bonds backed by commercial mortgage debt, according to a spokesman for the group.”

Looking Back:

One year ago, a study from the NAR showed that realtors were seeing a 13.6 percent decline in their median income. According to the MBA’s weekly survey, the mortgage loan application volume increased 12.8 percent from the previous season. Fed Chairman Ben Bernanke was expected to announce the end of the recession, and planned to keep rates at the record low. A report showed that state foreclosure prevention programs were failing to keep borrowers from losing their homes.

Existing home sales experienced a dramatic decrease of 27.2 percent in July, according to the NAR. Housing production decreased by 10 percent in June. The CAR reports California home sales decreased 20.8 percent in July. Statistics from the California Employment Development Department show that 7,100 jobs were lost from July 2009.

“According to statistics compiled by the Construction Industry Research Board (CIRB), permits were pulled for 4,165 total housing units in July, up 35 percent from the same month a year ago but down 10 percent from June. Permits for single-family homes totaled 1,951, down 9 percent from July 2009 and down 31 percent from the previous month, while multifamily permits totaled 2,214, up 134 percent from a year ago and up 25 percent from May.”

“The Mortgage Bankers Association (MBA) today released its mid-year ranking of commercial and multifamily mortgage servicers as of the end of June 30, 2010. Topping the list of firms is Wells Fargo with $462.8 billion in U.S. master and primary servicing, followed by PNC Real Estate/Midland Loan Services with $307.9 billion, Berkadia Commercial Mortgage with $202.6 billion, Bank of America Merrill Lynch with $133.4 billion and KeyBank Real Estate Capital with $124.7 billion.”

“California home sales decreased 20.8 percent in July compared with the same period a year ago, while the median price of an existing home rose 10.4 percent from July 2009, the CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.) reported today.”

Housing Wire“Disappointing Homes Sales Unlikely to Reverse Course” (8-24-10)

“Predictions that home prices may drop into double digits continue to drag down sales. Bill Gross, managing director of the world’s biggest bond fund, PIMCO remarked that the idea of a rebound anytime soon is ‘ludicrous.’ In a meeting at the US Treasury last week, Gross called for combining the government-sponsored entities into one entity that insures the majority of current and future originations.”

“Sales of U.S. previously owned homes probably plunged in July to the lowest level since March 2009, evidence the market is restrained by foreclosures and limited job growth, economists said before a report today. Purchases dropped 13.4 percent from June to a 4.65 million annual rate, according to the median of 73 forecasts in a Bloomberg News survey. A decline would be the third in a row.”

Orange County Register – “Corona del Mar is O.C.’s ‘coldest’ market” (8-24-10)

“The pricier the town, the harder it is to sell a home there right now, the latest O.C. home inventory report from Steve Thomas at Altera Real Estate shows. Corona del Mar, for example, was Orange County’s ‘coldest’ market in the past 30 days. In theory, it would take 11 1/2 months to sell all the homes on the market there at the current sales pace, the highest ‘market time’ for any O.C. community in the 30 days ending on Aug. 19. Other ‘cold’ markets likewise tend to be home to some of O.C.’s most expensive housing.”

Orange County Register“Real estate, building jobs down 5% in July” (8-24-10)

“Indeed, construction suffered the largest year-over-year decline among every employment category, the state Employment Development Department reported. Construction jobs fell by 7,100 positions from July 2009, down nearly 10%. Construction jobs totaled 65,700 in July, state figures show.”

Orange County Register“Broker: No tsunami of repo’d homes to hit market” (8-24-10)

“This shadow inventory has to be worked through, but is not going to occur as a tsunami of distressed properties to hit the market all at once. Instead, we are going to witness slow increases and drops over the next few years. This slow absorption will not pull down values like it did at the beginning of this downturn and it will keep a lid on any substantial appreciation. Once employment improves, the pathway to an eventual healthy and stable recovery will occur.”
