Type of Document: Mortgage

Types of Foreclosure:

Non judicial foreclosure may be held if the mortgage contains a power of sale clause.

Judicial foreclosure is used when the power of sale clause is not contained in the loan document.

Deficiency: Allowed in both judicial and non judicial foreclosure in some cases. In a judicial foreclosure the lender may waive their right to a deficiency and cut the foreclosure time down from one year to six months.

Redemption: Unless the sale is confirmed, the property may be redeemed for up to one year.
